Date Published: 10/12/2023 Desc: Duchess Light Tuna in Water (Canned) Notes: The article is subject to refusal of admission pursuant to Section 801(a)(3) in that the product appears to be misbranded within the meaning of: Section 403(a)(1) of the Act [21 U.S.C. §343(a)(1)], in that the product label is false and misleading. Specifically, the label states the product contains 30% textured soy protein while the formulation sheet indicates the product contains 20.42 % soy protein and 0.99 % soy fiber. Section 403(i)(1) of the Act [21 U.S.C. 343(i)(1)], in that the product label does not provide a statement of identity that is descriptive enough to convey the significant soy protein content alongside the tuna and is not in accordance with 21 CFR 101.3. In addition, the term “contains” should be reserved only for allergen declaration as required under section 403(w).
