- The article is subject to refusal of admission pursuant to Section 801(a)(3) in that the products appear to be misbranded within the meaning of: Section 403(e)(2) of the Act [21 U.S.C. § 343(e)(2)] and [15 U.S.C. 1453(a)(2) and (3)] of the Fair Packaging and Labeling Act (FPLA) because the label fails to declare the net quantity of contents in terms of U.S. customary units on the PDP in accordance with 21 CFR 101.7. For example, the units appear to be only declared in grams, not standard US measurements and the net quantity of contents is declared as “net wt: (450±5)g” which is not an accurate statement. We also note that the plus-minus sign is not provided for in 21 CFR 101.7.
