(19 V.S.A. §10(8)). Labor and Material Covered: The VT Agency of Transportation can require contractors employed on a state transportation improvement project to post a surety bond to the secretary of the agency for the benefit of suppliers of labor, materialmen, machinery, and others, to secure payment of the claims of creditors that supply goods, services, or labor to the project. (19 V.S.A. §10(9)). Notice Required: Claimants must file a sworn statement of claim under the bond with the secretary within 90 days after final acceptance of the project by the state, or within 90 days after the time taxes and contributions to the commissioner of labor are due and payable by the contractor. Within one year after filing the claim, the claimant must file suit in Superior Court, in the name of the secretary of transportation, to enforce the claim.
